Our Commitment to Compliance
EliteFlick (eliteflick.com) publishes editorial content in the entertainment space, including articles, reviews, and commentary that may quote, embed, or reference third-party material. We respect the copyright rights of others and expect the same respect from anyone who submits content to us or interacts with our site. We have adopted this policy in line with the notice-and-takedown framework described in 17 U.S.C. § 512 of the Digital Millennium Copyright Act (DMCA). If you believe material on our site infringes your copyright, we want to hear from you, and we will respond promptly to valid notices.
How to Submit a Takedown Notice
If you believe content on eliteflick.com infringes a copyright you own or represent, please send a written notice to the email address listed below. To be considered valid under Section 512(c)(3), your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved.
- Identification of the material you claim is infringing, along with enough detail (such as a direct URL) for us to locate it on our site.
- Your contact information, including your name, mailing address, telephone number, and email address, so we can reach you about the notice.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Notices that are missing any of these elements may take longer to process or may not qualify as valid takedown requests.
Where to Send Notices
Please send all copyright takedown notices to [email protected]. This is the dedicated email address we use to receive and review copyright complaints. We review incoming notices as quickly as we can and remove or disable access to infringing material expeditiously once we confirm a notice is valid.
Please note that EliteFlick has not registered a designated agent with the U.S. Copyright Office. The email address above is simply the contact point we ask you to use for copyright-related concerns about our site.
How to Submit a Counter-Notification
If you believe material we removed or disabled was taken down by mistake or misidentification, you may submit a counter-notification. Under Section 512(g)(3), your counter-notification should include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and where it appeared before removal.
- A statement, made under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if outside the United States, for any judicial district where EliteFlick may be found), and that you will accept service of process from the person who submitted the original takedown notice or their agent.
Please send counter-notifications to [email protected]. After we receive a valid counter-notification, we may forward it to the original complaining party. Under the process described in Section 512(g), the material may be restored in about ten to fourteen business days unless the original complainant informs us that they have filed a court action seeking to restrain the alleged infringer from continuing the activity.
Repeat-Infringer Policy
EliteFlick takes repeat infringement seriously. We keep records of valid takedown notices we receive. Contributors, guest authors, or users who are the subject of repeated valid infringement notices may have their content removed, their submission privileges suspended, or their access to our site terminated, depending on the circumstances.
Misrepresentations Liability
Section 512(f) provides that anyone who knowingly makes a material misrepresentation in a takedown notice or counter-notification may be liable for damages, including costs and attorney's fees incurred by the person harmed by the misrepresentation. Please make sure your notice or counter-notification is accurate and made in good faith before you submit it.
Disclaimer
EliteFlick is an editorial publication. Our articles, reviews, and commentary may quote, embed, link to, or reference third-party material, including images, video clips, or text excerpts, in ways we believe qualify as fair use under copyright law. We do not intend to infringe anyone's copyright. If we receive a valid notice showing that specific material on our site is infringing, we will remove or disable access to that material expeditiously.
